    Saving the LA for the ECOHR Nick. This is my neighbours buts that are being dragged to court. The particulars of claim were very thorough. I think torts that we spoke spoke about a few months earlier would be order of the day. It will be very costly for my neighbours if it goes my way.

    Good luck mikeee5. I really feel for you. I am 100% behind you, the courts must take a stance on this because too many people are now becoming harmed by badly sited, installed and operated wood burners. And the EHO that have the powers to intervene, abuse their powers by not investigating fully. And this sets neighbour against neighbour. I feel so strongly about this, as you have proved here that Hetas in their tech sheets are aware of possible problems of stacks installed to mimimun regs, not dispersing smoke and fumes away. Power to you mate for all our sakes.

    Thanks for the well wishes folks, interesting link Triassic. The local authority have turned a blind eye to the correct protocol as did the ombudsman! God help us if the judge brushes the technicalities under the carpet. The smoke is back with a vengence this evening. I've had a few jobs to do in and around my garage and my asthma is on its knees. I really hope it goes our way in court and these rotten gits get their due comeuppance.

    Bless you Dessie. It looks like my neighbours have accepted my challenge in court. The fire is being lit more frequent now! We're in the right here. I had a visit from a friend today that has recently moved to Cornwall. The fire was lit around 3pm and the fumes quickly flooded into my living room. I Said that is nothing step outside and have a wiff at the fumes out here! The fumes were full on, my friend said she had smelt nothing like it, she said that it was making her eyes water. I said this is nothing, it gets much worse than this! We are in the right here, I'm just going to tell it like it is when we get to court, that's all can do.

    Too many wood and coal fires in Cornwall. Not gas on the North Coast, they still use coal.

    I would get some ground glass top jars and collect some smoke, videos from a distance, plenty of evidence, testimonials from neighbours, eye witnesses from over the road. Take it all there with you.

    And don't let them side track about the compliance of the stove being used or the quality of the firewood, it's nothing to do with either of these. Try to keep the case focused on the performance (or lack of) of the chimney

    I am sure 'they' will argue that there can't be a nuisance as the stove and firewood comply with the regulations. The nuisance arises because the chimney fails to perform properly as per building regs discussed earlier. IMO it would be important to stop the case being side tracked on to compliant items that may or may not be used correctly - an endless subjective debate. The failure of the chimney is demonstrable and there is evidence and witnesses to support this.

    I have plenty of videos of the smoke coming to ground some of which are in the daytime and the smoke can clearly be seen heading downwards. I did not put these on youtube as they contained car registrations. Plenty of friends family and neighbours are prepared to stand as witnesses too. We have also got a few trump cards up our sleeves which hopefully will help sway the Judges decision our way.

    My friend has only recently moved to Cornwall Steamy, I think they are on the south coast. We`re heading down there next year for a break, will have to meet up for Cornish teas :bigsmile:

    They said tiny particulate matter, which can pass from the lungs to the bloodstream, may be to blame.

    Thanks for the link Triassic. Another warning by the experts. There's plenty of warnings on sites in other countries, It's about time more was done in the uk!

    Can anyone provide a link to archive weather forecasts? I videoed the smoke in July when HETAS inspected the installation. It was one of the hottest days of the year and there was a gentle breeze blowing the smoke away from my property. I have the date that the installation and commissioning took place and I suspect the wind was in the same direction which has ticked the box as conforming.

    I have it in writing via the freedom of information act that someone In Building Control said they had a certificate of conformity from the HETAS installer and said that was good enough for him. Because of this the LA have taken it that the chimney is working properly. The smoke that I have filmed coming to ground on my property is nonconforming and the Environmental Health officers have never been on my property during this scenario to make an assessment of the severity of the fumes! My neighbours have put forward their defence. As predicted it is very full with "the LA say we're doing nothing wrong" cards!

    It is entirely obvious even to a blind man on a galloping Horse, that the increased levels of Autism are much more likely, if not absolutely definately likely, to be due to heightened perceptions in respect of the Autisic spectrum, and the undoubted benefits of getting a child "statemented" however marginal the condition.

    My wife was a SS teacher btw.(Thats Secondary School btw!)

    I was walking back across the back field last week of a cold clear evening, when both our Morso wood burning stove and the Solarbayer gasifying log boiler were burning. It was absolutly impossible to tell, no smell, and absolutly zero visible emissions.
    Burning wood can be good, honestly!

    No it can't, but that does not mean we should carry on burning anything as a substitute.

    The issue with health is more to do with the PM10 and 2.5 rather than visible smoke and odour.

    Gentlemen,
    I passionately believe in providing the best for the vast bulk of the population who lie within the reasonable "norms" of health, as opposed to attempting to provide an impossibly perfect world for those unfortunates who inhabit the very fringes of sustainable health, either physical or mental.
    This also applies to the "rights" to childbirth demanded by those, who nature (and indeed perhaps nuture/learned behavouir) has for various reasons, deemed unsuitable/unsustainable/unviable breeding material.
    i.e. Let Darwin work his magic.

    Another visitor tonight stepping through my back door, clothes stinking of wood smoke. That's another witness to the list.

    Some of the information that I have received via the court gives reference to the HETAS inspection in July. It says that the inspector found 3 anomalies with the installation one being the missing hearth plate as mentioned earlier in the thread. Apparently none of the oversights would have a bearing on the "alleged smoke problem" !
