Sounds like my solicitor has slipped up when he filed the case with the court. Apparently he put it down as a fast track which takes 1 day. He moved it to a multi track as he thinks it could take 2 - 3 days due to the amount of witnesses. The judge said if it had been done as a multi track from a start we would probably had the trial by now!

Cheers Tony. Got to put up with another burning season until the trial. March isn't that far away though when you think about it. Thanks for your continued support mate.

Would your neighbour also do a diary with photos do you think?

We've started taking videos again, unfortunately I stopped entering the events in a diary as I thought we would have had the trial by now!

There expert has said he can't except the particulate readings for court as they are not in a recognised standard. If you remember back my monitor measure particulates in .01 of a cubic inch. This guy is wanting to know exactly which particulates are entering my home and which ones are making my asthma worse! I hope my neighbours have a good size wallet. I know when I looked in to this kind of monitor was getting quotes for over 30 k. I couldn't find anyone that would be interested in a domestic case.

I think that sort of legal arguement was settled a decade or so ago with the asbestos cases.
Keep logging the particulates, just make sure the monitor is in the same place and you have it datestamped. You need to log constantly, not just when they light the fire.
You are not going to be arguing about the levels, just the change in levels and if they breach the threshold, and when.

Good points steamy. My argument here is also "it's my particulate monitoring v the local authority not having the equipment to do any sort of testing".

    Hi Mikee5
There is a Scottish report completed on passive smoking. It contains the formula they used to convert dylos readings (count) into umg (weight). This report was published and seems to give credence to using dylos machines in domestic situations. Their expert should be made aware of this use of dylos readers as it was completed by Scottish university boffins and believe help ban smoking in cars with kids? It proves accepted use of a dylos reader in domestic situations! Keep up the fight!

    This one?

    http://tobaccocontrol.bmj.com/content/early/2013/09/17/tobaccocontrol-2013-051188

    Abstract

Objective To determine if a low-cost particle counter, the Dylos DC 1700, can be used in homes to quantify second-hand smoke (SHS) concentrations.

Methods Participants were recruited from a hospital-based study of attitudes on smoking. Two photometric devices (Dylos DC1700 and Sidepak AM510 Personal Aerosol Monitor) capable of measuring and logging concentrations of particulate matter were placed in smoking and non-smoking homes for approximately 24h. Acquired data were randomly allocated to one of two groups: one was used to generate a calibration equation using regression techniques; the second was used for validation of the generated model. The mean difference and limits of agreement between the two instruments were calculated using the validation dataset. Summary air-quality results were also compared across the entire dataset.

Results Over 500 001 minute concentration measurements were collected from 34 homes. 25 301 randomly selected paired-measurements were used to generate a calibration equation (R2 0.86) converting the particle number concentration from the Dylos to a mass concentration of PM2.5 as measured by the Sidepak. The mean difference (limits of agreement) between the remaining 25 102 paired measurements was −0.09 (−49.7 to 49.5) with 3.2% of values outside the limits of agreement. Differences in the air quality information generated by the two instruments were generally small and unlikely to impact on user interpretation.

Conclusions The Dylos appears to be a valid instrument for measuring PM2.5 in household settings. The Dylos may be useful in air quality-based interventions designed to change smokers’ behaviours with the possibility of encouraging cessation and/or smoke-free homes.

The document is: 'Scottish School of Public Health - briefing 2 May 2013' (Sean Semple). (Last page at bottom shows their conversion equation.) Proof use of Dylos Reader in domestic situation.

Ahh thanks. I think I've found that at:

    https://ssphr.files.wordpress.com/2013/05/ssphr-briefing2-smoke-free-homes.pdf

The reference it gives looks likely to be better for the experts, since it is peer-reviewed and seems to have more discussion of the strengths and weaknesses of the comparison method they used:

The information is only of value if you have a Solicitor who has actually done their homework and is prepared to use the information in support of your case!

I spoke to my solicitor yesterday and he sounded much more assertive. There's talk of a site meeting with both expert witnesses and the legal representatives. My solicitor is trying to find out what their expert witness wants to actually do in terms of his report.

The meeting is set for next week for their expert to visit my property. Will be interesting to see what the brings!

I have lots of facts that I need to get in front of the judge. I have emailed my solicitor a complete breakdown from start to finish of the councils involvement, a breakdown of my expert witness report and the HETAS bulletins etc. I'm not sure if he has put it in the disclosure but I would like to get all the points across to the judge as I am not confident the solicitor or representative will put all the crutial facts over on the day of the trial. Cananyone recommend anything I can do to make sure the important facts are under the judges nose?

    Cheers

    Mike

Who will be at this meeting apart from yourself and their expert ?

Is it a meeting, or a visit ?

If it's a meeting, it maybe needs to be minuted...
and maybe you should be represented ?
    (by a "knowledge engineer") ?
(in practice, this might mean hiring the services of a surveyor for a half-day or the day, even...)

Otherwise, does your house insurance cover you for legal representation ?
In which case, you might be able to get them to cough up partially or wholly...)

    Just asking !

If you are mortgaged, maybe your bank needs to be in the know...
    etc.
    ======
This has got nothing to do with anything, but I knew of a bloke (Mr B) in your condition, his neighbour was a radio ham, and Mr B's television reception was going all wonky and impossible.

Mr B complained to the Post Office.

P.O. sent out an inspector to check out the neighbour's installation.
    It was OK,
and Mr B got a bill to pay, and also had to change his aerial as it was NOK...
    Just saying...

    PHEW !

After all of this is over, you need to book yourself a good holiday (-:

Definitely will need a very long break after this is over GG. Apparently it's just me and my wife and their expert witness at the meeting at our property. I have received a letter from him via the solicitors and he is making quite a few demands in it i.e. He can't accept the particulate readings for court as they are in imperial measurements! Apparently he has phoned my expert witness demanding similar. I think my EW has chewed him up and spat him out !!

Ask him, when he turns up in his car, whether his engine is to the Euro 5 standard, or the BSA standard
(british standard automobile) (oops, I nearly wrote something else...)

If it was me I would either politely tell him I was going to record the meeting or else ask a calm, friendly, disinterested neighbour to be there as well. Might help to be sure everybody is on their best behaviour.

I'd be inclined not to answer too many questions during the visit as anything you say might get twisted around. Just let him visit, do his thing and leave. He's there to get the site layout right? Not collect evidence for the defence from you. The more friendly and chatty he appears the more I'd beware.
